THE last may have not been heard over the disagreement between the legislature and the executive over the N1.04 trillion fine imposed on South African telecommunication giant, MTN, by the Nigeria Communications Commission, NCC, which was later reduced to N330bn.
The reduction was in violation of ongoing investigation into the matter by the House of Representatives. A member of the House of Representatives, Raphael Igbokwe, has dragged to the Federal High Court, Abuja, the Attorney General of the Federation, AGF, Abubakar Malami, SAN, and the Minister of Communication Technology, Adebayo Shittu, seeking for determination as to whether the defendants had power under the laws of the land to reduce the fine imposed on MTN. Also joined in the suit No FHC/ABJ/CS/448/2016, are the Nigerian Communications Commission, and MTN Communications Limited.
Igbokwe, in his affidavit, stated that the reason he instituted the case against the defendants was because he had great interest and was committed to the development of the nation’s jurisprudence. He contended that the AGF and Minister of Justice and the Minister of Communications Technology lacked powers to amend, alter, adjust or vary any provisions of a legislation or any other law validly made by the National Assembly, or any rules, regulations and orders validly made by any legislator pursuant to an Act of the National Assembly.
